News on the Employment Rights Bill

The House of Lords has rejected the Government’s proposal to make unfair dismissal rights a day one right with a statutory probationary period.

Instead, the House of Lords have taken the sensible approach of reducing the required qualifying period required of an employee wanting to bring a claim for ordinary unfair dismissal from two years to six months, thus removing the requirement for what was likely to become an overly technical statutory probationary period.

Providing that the amendment holds when the Bill goes back to the House of Commons this does appear that common sense approach for all concerned.
